Definitions and Interpretation The terms used in these Terms and Conditions and in the Riviera Apartments’s Web Policy and the Riviera Apartments’s Privacy Policy have the following meanings: “Riviera Apartments” means Riviera Apartments.  “England” means the country of England. “Terms and Conditions” means the terms and conditions which appear on the website of Riviera Apartments at the time you make a reservation or booking using our website. “Third Party Providers” and “providers” means any person or entity, other than Riviera Apartments, which offers goods or services on this website of Riviera Apartments. “We” and Our” and “Us” means Riviera Apartments. “website” means this website of Riviera Apartments, unless the reference is to the website or a linked website of a third party provider. “You” and “Your” means you, the person, client or entity who uses this website of Riviera Apartments. In these terms and conditions: words importing a singular number only include a plural number and vice versa; words importing a gender include the other gender.  Administration fee means a fee of £50 for services and tasks that would not normally be part of the booking process.   

The terms, conditions and requirements in the following policies which are to be found on the Riviera Apartments website shall form part of these terms and conditions as if they had been set out here in full. Those policies are: Riviera Apartments’s Web Policy Riviera Apartments’s Privacy Policy.  


A non-refundable 25% deposit is payable on booking, the balance is payable 45 days prior to the commencement of the letting period booked.  Full payment will be required if the booking is made less than 45 days prior to the commencement of the letting period. The deposit is returnable only if the booking is not accepted.  A confirmation of your booking will be issued upon receipt. For payment we accept credit cards, debit cards and BACs payments. 


Non-payment after reasonable attempts to contact the guest will be treated as a cancellation and we will attempt to re-let the property without reference to the client who will remain liable for the payment of the full amount.  If we are successful in re-letting the property at an amount equal to 20% of the rent, administration fee will be payable. 


Cancellation means that the property will not be occupied by any members of your party. 


If we should need to cancel the booking we will refund in full all monies paid to us by you.  Responsibility and financial liability of Riviera Apartments shall be limited to the return of monies received in the event of accommodation booked in good faith not being available due to circumstances beyond our control and the clients shall have no further claim against Riviera Apartments. 


Should you need to cancel with less than 8 weeks prior to the date of the booking then you will be bound by this agreement to pay us in full for that booking.  Payment must be made whether or not you have at the time of cancellation paid in full for the booking.  By booking with us you agree to take out holiday insurance to cover you for that eventuality. 
We shall seek to relet the property at the best possible price but not necessarily at the advertised price. If successful, we will normally return the balance less any discounts we have had to apply to you within 14 days of the original arrival date.  If we are unsuccessful in reletting the property no monies will be refunded to you.  Deposits are non-refundable. 


Accommodation will be available for your occupation from the latest time of 3.00pm on the start date of the booking.  Instructions will be sent regarding the collection of keys to your apartment along with parking information and directions.    

Accommodation must be vacated by 10.00am on the departure date, this allows cleaning and maintenance to be carried out.  Riviera Apartments will provide the accommodation to a high standard of cleanliness and presentation, with a complete inventory for you. All accommodation must be left in a clean and tidy condition as you found it (except for dirty linen and towels). All rubbish must be removed to the refuse area and glass must be separated.   


Please note that we reserve the right to charge a Good Housekeeping Charge to cover additional cleaning costs.  In the event that your accommodation is left in a less than satisfactory condition (including but not exclusively, removal of rubbish, glass bottles, food, dirty dishes, contents of fridges and freezers, cigarette ends left on balconies and/or smell of smoke within the apartment) we will charge £50 within 4 days of your departure to cover additional cleaning costs.  Guests are not expected to strip beds. 


If upon arrival or anytime during your holiday you have any problems or difficulties with your accommodation or other guests we must be contacted immediately so that, if possible, appropriate action can be taken during you stay. No complaints will be considered after the completion of your holiday unless they were raised when they arose. While we will make every effort to attend to repairs to properties/furniture/equipment/facilities which may be faulty or fail during your holiday no guarantees will be given and no refunds will be granted should any breakdown occur which cannot be immediately rectified. 

Any problems found with any appliance or fixture or fitting must be reported to us and we will ensure that within a reasonable time that this is repaired or alternative arrangements made.  Under no circumstances should any guest attempt repairs to the property or its contents as this will invalidate service contracts, warranties and agreements and charges for such repairs will then pass to the hirer.  The hirer undertakes to keep the premises and all fixtures, fittings and effects in or on the premises in the same state of repair and condition as the same are in at the start of the letting and shall report and pay to the owners the value of any part of the premises, furniture, fixtures, fittings and effects so destroyed or damaged as to be incapable of being restored to its former condition. 


Parties and events are not permitted at Riviera Apartments.   We do not permit stag or hen parties, loud music, shouting or unreasonable noise after midnight or any type of behaviour which spoils the enjoyment of other guests.  Additional guests who are not on the booking form are not permitted to visit unless prior consent is given by the owner. We ask for your credit/debit card details and the authority to charge for any breakages and/or damage and/or items missing from the inventory at cost up to a maximum of £500.00 . In addition, if anti-social behaviour impacts the enjoyment of other guests we reserve the right to charge £500 which will be used to directly compensate the affected guests. 

The person signing the booking form or the lead booker, who must be a member of the party occupying the property, agrees to the booking conditions on behalf of all the persons included on the booking form.  Only the persons stated on the booking form at the time of booking will be allowed to stay in the property, unless otherwise agreed in writing by the owners. Riviera Apartments reserves the right to refuse entry to the entire party if this condition is not observed.   

Riviera Apartments and its agents reserve the right to decline entry and accommodation or to expel the occupier or visitor for conduct which in their sole view is detrimental to the property as a whole or the comfort of other visitors.  Riviera Apartments reserves the right to enter a property at any time but will endeavour to do so when convenient to the occupier. 


By making a Booking with us you have entered an agreement in which you undertake on behalf of yourself and the members of your Booking (including children), to adopt the following standards of behaviour: 

a) act in a courteous and considerate manner towards us, our staff and other guests;
b) supervise children properly so that they are not a nuisance or danger to themselves or others.

All guests in the group must not: 
  • Smoke anywhere in the Apartment Building except on the balcony and dispose of cigarettes in a hygienic and safe manner.
  • Commit any criminal offence or undertake any criminal activity.
  • Invite guests to your accommodation without prior consent by Riviera Apartments.
  • Use any unlawful drugs
  • Create any undue noise or disturbance.
  • Use our wifi for unlawful purposes.


For purposes of insurance, to maintain the quality of the fixtures and fittings and out of consideration for other guests, smoking is NOT permitted in any apartment but is acceptable on the balconies assuming that cigarette ends will be disposed of in a safe and discreet manner and not left in the plant pots or decking area. 


We have a private elevator for the guests at Riviera Apartments and a private stairwell.  We have a full maintenance contract with a local company for servicing and maintenance of the lift.  If the lift should fail we will report the failure to them (P&P Lifts) and request that measures are taken to ensure it is back in working order as quickly as possible.  When a service is due on the lift we will endeavour to advise guests and give a timescale of works.  Riviera Apartments cannot be held responsible for the failure of the lift or inconvenience caused by a lift service.   
The lift is for a maximum of 3 average sized adults or luggage equivalent.  This is clearly stated in the arrival information and on the lift door at the top and bottom of the lift.  We kindly request that guests do not squeeze themselves in and risk the lift failing.  If the lift fails and the engineer reports that it is overloaded with people then the guests will be charged the callout fee.   


We have two apartments that do not have stairs within them, Penthouse One and Penthouse Two.  If guests have mobility problems please contact us to discuss requirements before booking.   


In line with the rest of the Hospitality Sector, we have a Dignity at Work and Zero Tolerance policy.  This means that aggressive or violent behaviour towards our staff or any member of the public within our premises will not be tolerated under any circumstances and guests may be asked to leave.   


Teignmouth is a lively seaside town and events such as (but not exclusively) Air Shows, Regattas, Live Bands and Carnivals take place on occasion within the town and on The Den (the green on Teignmouth seafront) especially during bank holidays weekends and school holidays.  Riviera Apartments does not take any responsibility for events held outside of it’s premises on public or private land as such events are completely beyond our control and as such we cannot offer compensation.   


Maintenance and improvements take place all year round, we have an extremely exposed position and the exterior needs constant attention which is a huge task.  We will do our best to ensure you are not inconvenienced during any maintenance and always endeavour to inform guests beforehand but occasionally this is not always possible such as after storm damage and no compensation will be paid in these instances.


Riviera Apartments, its employees or agents are not to be responsible for the loss of any valuables or property left on or around the premises at any time which includes the car park area.  All guests, their friends, families and visitors must ensure that they take all reasonable steps to ensure their own safety and that of others whilst on the property. The owners will not accept responsibility for any injury or loss caused whilst in or around the property.  By booking you agree to take out holiday insurance to cover you for that eventuality 

Riviera Apartments cannot be held responsible for any accident, injury, theft or damage to persons or property whilst on the premises which includes the private parking area.    

By using this website and paying for your reservation by credit/debit card you represent and warrant that you are of sufficient age to use this site and create legal binding obligations for any liability incurred. You agree that you will be personally and financially responsible for the use of this website and for anyone you have supplied your login information to or who otherwise has access to or uses your login information. 

Any reservation made on the Riviera Apartments online booking website is made at your own risk. As you are entering information directly into the reservations system, all information entered by you will be assumed to be correct and final. Any errors or omissions will be the responsibility of the person entering any information into our online system. Riviera Apartments will not be held responsible nor will Riviera Apartments accept any financial liability for any errors or omissions in the information provided. If there is an error, omission or mistake regarding price through the online booking system compared to the published rates on the website to the loss or detriment of Riviera Apartments then the client will pay the balance due.     


The use of this website is at your own risk. Riviera Apartments does not warrant that the website will operate error-free or that this web site and its server are free of computer viruses or other harmful material. If you use this website and your equipment is in need of servicing or replacement or if you lose data or experience any problems, Riviera Apartments will accept no responsibility or liability for any damage, losses and costs you may suffer or incur in any circumstances.   In no event or circumstances shall Riviera Apartments be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with the use of this website or with the delay or inability to use this website, or for any information, software products, and services obtained through this website, or otherwise arising out of the use of this website, whether based on contract, tort, strict liability or otherwise, even though Riviera Apartments, its affiliates and or any of their suppliers have been advised of the possibility of damages.   Riviera Apartments, to the fullest extent permitted by law, makes no representations or warranties, either express or implied, in relation to: the use of any information, software or software products or goods and/or services contained or referred to in this website any goods and/or services offered or provided by any third party provider the type, quality or standard of any goods and/or services offered or provided by Riviera Apartments or by any third party provider or whether they are or could be fit or used for any purpose (even if that purpose has been made known) Riviera Apartments, to the fullest extent permitted by law, expressly disclaims and excludes any and all liability to anyone using this website, making any reservation on this website or ordering any goods and/or services using this website. Without limiting the foregoing in any way, this exclusion of liability extends to any economic and consequential losses, any damages and costs, all claims involving personal injury and/or death and all loss, damage or destruction of property   In relation to any goods or services offered by or ordered from third party providers, you should check with the relevant third party provider to see whether any warranties are given and whether any exclusions or limitations apply. Riviera Apartments does not act for or represent any third party providers and does not accept any liability in relation to any third party providers or for the goods and/or services that they offer or provide, including (but not by way of limitation) for any acts or omissions of third party providers or for any representations or misrepresentations made by them. You should contact any third party providers direct to request any information or details you may require Jurisdiction This Riviera Apartments website and various component parts, including these Booking Terms and Conditions are governed exclusively by the laws of England and you agree to submit to the exclusive jurisdiction of the Courts of England. 

Riviera Apartments reserves the right to change these Booking Terms and Conditions at any time and without notice. Any future reservations you may make will be made subject to the terms and conditions which apply at the time a booking is made and you are advised to read all the terms and conditions carefully on each occasion you wish to make a reservation and prior to making the reservation. 

Riviera Apartments  are used as holiday accommodation and are therefore exempt from security of tenure under the Rent Act 1977. 


Compensation payments will not apply where we cannot fulfil our obligations due to circumstances beyond our control. This would mean any event we or the owners cannot foresee with all due care; i.e. riots, war or threat of war, terrorist activity, civil strife, natural or nuclear disaster, industrial dispute, adverse weather conditions, fire epidemic or health risk and similar factors beyond our control. 

These booking conditions supersede all previous issues.
