COVID-19 – AMENDMENT
Guests that make new bookings from 4th July 2020 will need the pay the normal 25% deposit at the time of booking. If the government forbid guests from travelling to us for their holiday due to a local lockdown in the lead bookers address area, or if there is a national or local lockdown in the Teignmouth area and we have to cancel your booking then we will refund your deposit (and balance if applicable) to you. The lead bookers address is the address at which the local lockdown must occur. Please note this is the only instance that you would receive your deposit back as under normal circumstances it is non-refundable. All other terms and conditions apply which can be found at the bottom of our website.
A non-refundable 25% deposit is payable on booking, the balance is payable 45 days prior to the commencement of the letting period booked. Full payment will be required if the booking is made less than 45 days prior to the commencement of the letting period. The deposit is returnable only if the booking is not accepted. A confirmation of your booking will be issued upon receipt. For payment we accept credit cards, debit cards and BACs payments.
For any other cancellation reasons, as always we suggest you take out UK travel insurance.
Non-payment after reasonable attempts to contact the guest will be treated as a cancellation and we will attempt to re-let the property without reference to the client who will remain liable for the payment of the full amount. If we are successful in re-letting the property at an amount equal to 20% of the rent, administration fee will be payable.
Cancellation means that the property will not be occupied by any members of your party.
CANCELLATION BY US
If we should need to cancel the booking we will refund in full all monies paid to us by you. Responsibility and financial liability of Riviera Apartments shall be limited to the return of monies received in the event of accommodation booked in good faith not being available due to circumstances beyond our control and the clients shall have no further claim against Riviera Apartments.
CANCELLATION BY YOU
Should you need to cancel with less than 8 weeks prior to the date of the booking then you will be bound by this agreement to pay us in full for that booking. Payment must be made whether or not you have at the time of cancellation paid in full for the booking. By booking you agree to take out holiday insurance to cover you for that eventuality.
We shall seek to relet the property at the best possible price but not necessarily at the advertised price. If successful, we will normally return the balance less any additional administration and extra cleaning charges to you within 14 days of the original arrival date. If we are unsuccessful in reletting the property NO monies will be refunded to you.
ARRIVAL & DEPARTURE
Accommodation will be available for your occupation from strictly 3.00pm on the start date of the booking. Instructions will be sent regarding the collection of keys to your apartment along with parking information and directions. Please note that private parking is 200 yards from the building and there is space for one car per apartment only. Please note that Penthouse Four does not have a private parking space and a permit will be provided for guests within this apartment except for stays of less than 6 nights when any parking charges will be reimbursed.
Accommodation must be vacated by 10.00am on the departure date, this allows cleaning and maintenance to be carried out. Riviera Apartments will provide the accommodation to a high standard of cleanliness and presentation, with a complete inventory for you. All accommodation must be left in a clean and tidy condition as you found it (except for dirty linen and towels). All rubbish must be removed to the refuse area and glass must be separated. The refundable security deposit (See below) will not be returned should the accommodation be left below this standard.
GOOD HOUSEKEEPING CHARGE
Please note that we reserve the right to charge a Good Housekeeping Charge to cover additional cleaning costs. In the event that your accommodation is left in a less than satisfactory condition (including but not exclusively, removal of rubbish, glass bottles, food, dirty dishes, contents of fridges and freezers, cigarette ends left on balconies and/or smell of smoke within the apartment) we will charge £50 within 4 days of your departure to cover additional cleaning costs. Guests are not expected to strip beds.
If upon arrival or anytime during your holiday you have any problems or difficulties with your accommodation or other guests we must be contacted immediately so that, if possible, appropriate action can be taken during you stay. No complaints will be considered after the completion of your holiday unless they were raised when they arose. While we will make every effort to attend to repairs to properties/furniture/equipment/facilities which may be faulty or fail during your holiday no guarantees will be given and no refunds will be granted should any breakdown occur which cannot be immediately rectified.
Any problems found with any appliance or fixture or fitting must be reported to us and we will ensure that within a reasonable time that this is repaired or alternative arrangements made. Under no circumstances should any guest attempt repairs to the property or its contents as this will invalidate service contracts, warranties and agreements and charges for such repairs will then pass to the hirer. The hirer undertakes to keep the premises and all fixtures, fittings and effects in or on the premises in the same state of repair and condition as the same are in at the start of the letting and shall report and pay to the owners the value of any part of the premises, furniture, fixtures, fittings and effects so destroyed or damaged as to be incapable of being restored to its former condition.
Parties and events are not permitted at Riviera Apartments. We do not permit loud music, shouting or unreasonable noise after midnight or any type of behaviour which spoils the enjoyment of other guests. Additional guests who are not on the booking form are not permitted to visit unless prior consent is given by the owner. We ask for your credit/debit card details and the authority to charge for any breakages and/or damage and/or items missing from the inventory at cost up to a maximum of £500.00. In addition, if anti-social behaviour impacts the enjoyment of other guests we reserve the right to charge £500 which will be used to directly compensate the affected guests.
The person signing the booking form or the lead booker, who must be a member of the party occupying the property, agrees to the booking conditions on behalf of all the persons included on the booking form. Only the persons stated on the booking form at the time of booking will be allowed to stay in the property, unless otherwise agreed in writing by the owners. Riviera Apartments reserves the right to refuse entry to the entire party if this condition is not observed.
Riviera Apartments and its agents reserve the right to decline entry and accommodation or to expel the occupier or visitor for conduct which in their sole view is detrimental to the property as a whole or the comfort of other visitors. Riviera Apartments reserves the right to enter a property at any time but will endeavour to do so when convenient to the occupier.
For purposes of insurance, to maintain the quality of the fixtures and fittings and out of consideration for other guests, smoking is NOT permitted in any apartment but is acceptable on the balconies assuming that cigarette ends will be disposed of in a safe and discreet manner and not left in the plant pots or decking area.
We have a private elevator for the guests at Riviera Apartments and a private stairwell. We have a full maintenance contract with a local company for servicing and maintenance of the lift. If the lift should fail we will report the failure to them (P&P Lifts) and request that measures are taken to ensure it is back in working order as quickly as possible. When a service is due on the lift we will endeavour to advise guests and give a timescale of works. Riviera Apartments cannot be held responsible for the failure of the lift or inconvenience caused by a lift service.
AGGRESSION TOWARDS STAFF
In line with the rest of the Hospitality Sector, we have a Dignity at Work and Zero Tolerance policy. This means that aggressive or violent behaviour towards our staff or any member of the public within our premises will not be tolerated under any circumstances and guests may be asked to leave.
Riviera Apartments, its employees or agents are not to be responsible for the loss of any valuables or property left on or around the premises at any time which includes the car park area. All guests, their friends, families and visitors must ensure that they take all reasonable steps to ensure their own safety and that of others whilst on the property. The owners will not accept responsibility for any injury or loss caused whilst in or around the property. By booking you agree to take out holiday insurance to cover you for that eventuality
Riviera Apartments cannot be held responsible for any accident, injury, theft or damage to persons or property whilst on the premises which includes the private parking area.
By using this website and paying for your reservation by credit/debit card you represent and warrant that you are of sufficient age to use this site and create legal binding obligations for any liability incurred. You agree that you will be personally and financially responsible for the use of this website and for anyone you have supplied your login information to or who otherwise has access to or uses your login information.
Any reservation made on the Riviera Apartments online booking website is made at your own risk. As you are entering information directly into the reservations system, all information entered by you will be assumed to be correct and final. Any errors or omissions will be the responsibility of the person entering any information into our online system. Riviera Apartments will not be held responsible nor will Riviera Apartments accept any financial liability for any errors or omissions in the information provided. If there is an error, omission or mistake regarding price through the online booking system compared to the published rates on the website to the loss or detriment of Riviera Apartments then the client will pay the balance due.
USE OF WEBSITE
The use of this website is at your own risk. Riviera Apartments does not warrant that the website will operate error-free or that this web site and its server are free of computer viruses or other harmful material. If you use this website and your equipment is in need of servicing or replacement or if you lose data or experience any problems, Riviera Apartments will accept no responsibility or liability for any damage, losses and costs you may suffer or incur in any circumstances. In no event or circumstances shall Riviera Apartments be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with the use of this website or with the delay or inability to use this website, or for any information, software products, and services obtained through this website, or otherwise arising out of the use of this website, whether based on contract, tort, strict liability or otherwise, even though Riviera Apartments, its affiliates and or any of their suppliers have been advised of the possibility of damages. Riviera Apartments, to the fullest extent permitted by law, makes no representations or warranties, either express or implied, in relation to: the use of any information, software or software products or goods and/or services contained or referred to in this website any goods and/or services offered or provided by any third party provider the type, quality or standard of any goods and/or services offered or provided by Riviera Apartments or by any third party provider or whether they are or could be fit or used for any purpose (even if that purpose has been made known) Riviera Apartments, to the fullest extent permitted by law, expressly disclaims and excludes any and all liability to anyone using this website, making any reservation on this website or ordering any goods and/or services using this website. Riviera Apartments reserves the right to change these Booking Terms and Conditions at any time and without notice. Any future reservations you may make will be made subject to the terms and conditions which apply at the time a booking is made and you are advised to read all the terms and conditions carefully on each occasion you wish to make a reservation and prior to making the reservation.
Riviera Apartments are used as holiday accommodation and are therefore exempt from security of tenure under the Rent Act 1977.
Compensation payments will not apply where we cannot fulfil our obligations due to circumstances beyond our control. This would mean any event we or the owners cannot foresee with all due care; i.e. riots, war or threat of war, terrorist activity, civil strife, natural or nuclear disaster, industrial dispute, adverse weather conditions, fire epidemic or health risk and similar factors beyond our control.
These booking conditions supersede all previous issues.
